1. Acceptance of Terms

By accessing or using LookApex ("the Service"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and LookApex ("we," "us," or "our").

No Messaging Feature: LookApex does NOT provide chat, messaging, or direct communication features between users. All interactions are limited to public actions (check-ins, respect, court submissions). Users cannot exchange private messages through the Service.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

Your continued use of the Service following the posting of any changes to these Terms constitutes acceptance of those changes.

2. Eligibility & Age Requirements

To use LookApex, you must meet ALL of the following requirements:

  • Age Requirement: You must be at least 16 years old to use the Service without parental consent. Users under 16 years of age require verified parental or guardian consent.
  • Legal Capacity: You must have the legal capacity to enter into a binding contract.
  • Accurate Information: You must provide accurate and complete registration information.
  • No Prior Bans: You must not have been previously banned or removed from the Service.
  • Physical Capability: You must be physically capable of engaging in basketball and related activities, or acknowledge any limitations you may have.

2.1 Accuracy of Age Information

By providing your birth year during registration, you represent and warrant that:

  • The age information you provide is accurate and truthful
  • If you are under 16, you have obtained valid parental consent before creating an account
  • You understand that providing false age information is a material breach of these Terms
  • You accept full responsibility for any consequences arising from age misrepresentation

If we discover age misrepresentation: We reserve the right to immediately suspend or terminate your account without notice. We are not obligated to conduct proactive age verification checks, and our failure to detect age misrepresentation does not constitute negligence or waive our rights under these Terms.

No Liability: LookApex shall not be liable for any damages, claims, or legal action arising from a user's misrepresentation of their age. Users who provide false age information agree to indemnify and hold harmless LookApex from any such claims.

3. Safety & Physical Activity Disclaimer

By using this Service, you acknowledge and agree that:

  • You voluntarily assume all risks associated with physical activities at basketball courts
  • You are solely responsible for your own safety and well-being
  • LookApex does not inspect, verify, or guarantee the safety of any court location
  • Court conditions may be hazardous (wet surfaces, broken equipment, poor lighting, etc.)
  • You should consult a physician before engaging in physical activities
  • You should carry appropriate insurance for sports-related injuries
  • You are responsible for assessing the safety of any location before playing

Meeting Strangers: When meeting other users at courts, you do so at your own risk. We do not perform background checks on users and cannot guarantee the behavior or intentions of any user. Always meet in public places, inform others of your whereabouts, and trust your instincts.

Minors: Parents and guardians are responsible for supervising minors at all times when using the Service or visiting courts discovered through the Service.

4. User Conduct

You agree NOT to:

  • Create fake courts, check-ins, or user profiles
  • Harass, abuse, stalk, threaten, or intimidate other users
  • Use the Service for any illegal purposes
  • Share inappropriate, offensive, or harmful content
  • Attempt to manipulate, hack, or exploit the system
  • Create multiple accounts to circumvent bans or restrictions
  • Impersonate any person or entity
  • Collect or harvest user information without consent
  • Use the Service to send spam or unsolicited communications
  • Interfere with or disrupt the Service or servers
  • Engage in any activity that could harm minors
  • Promote violence, discrimination, or hatred

Violation of these conduct rules may result in immediate account termination without notice or refund.

4.1 Bot Protection & Automated Verification

To protect our Service from automated abuse, spam, and malicious bots, we use Cloudflare Turnstile for automated bot detection during registration and login.

  • Turnstile runs automatically in the background - no puzzles or image selection required
  • It analyzes browser behavior and characteristics to verify you are human
  • By using our Service, you consent to this automated verification process
  • If verification fails, you may be temporarily blocked from registration or login
  • Attempting to bypass or circumvent bot protection is a violation of these Terms

4A. Content Moderation & Warning System

To maintain a safe and respectful community, LookApex employs automated content moderation that includes detection of inappropriate language and a progressive warning system.

4A.1 What Constitutes a Violation

The following content is prohibited and will trigger our moderation system:

  • Profanity, slurs, and offensive language (in any language)
  • Hate speech, discrimination, or harassment
  • Sexual or explicit content
  • Threats or promotion of violence
  • Spam or promotional content
  • Deliberately misleading or false information

4A.2 Three-Strike Warning System

When a violation is detected, the following progressive actions are taken:

  • First Violation: Warning message displayed. The content is not submitted and the user is informed of the violation. This warning is recorded.
  • Second Violation: Second warning message displayed. The content is not submitted. User is informed this is their final warning before account restrictions.
  • Third Violation: Account is automatically banned. The user loses access to the Service. This action is immediate and automatic.

4A.3 Appeal Process

If you believe a warning or ban was issued in error, you may appeal by contacting us:

  • Email: support@lookapex.com
  • Include your account email and a description of the situation
  • Appeals are reviewed within 7 business days
  • Our decision on appeals is final

4A.4 Data Collection for Moderation

When a violation is detected, we record: the type of violation, the context (which form/feature), and a timestamp. This data is used for enforcing our policies and is handled according to our Privacy Policy. See Privacy Policy section 1A for full details on moderation data retention.

4A.5 Administrative Monitoring

We reserve the right to monitor, review, and moderate user-generated content. Our authorized moderation team may access account information and content to investigate reported violations, respond to user support requests, and enforce these Terms. All administrative actions are logged and subject to internal accountability measures.

4B. Non-Compete & Restricted Use

4B.1 Prohibited Competitive Activities

You agree that you will NOT, directly or indirectly:

  • Use information, data, or insights gained from the Service to develop, enhance, or operate a competing basketball court finder, sports location app, or similar service
  • Use the Service for competitive intelligence or market research purposes
  • Analyze our features, user interface, user experience, or business model to create similar products
  • Recruit our users to competing platforms or services
  • Copy our gamification mechanics, badge systems, or engagement features
  • Use our court database, location data, or user-generated content for any commercial purpose
  • Benchmark our Service against competing products for commercial purposes

4B.2 Disclosure Requirements

If you are affiliated with, employed by, or consulting for any company that operates or plans to operate a competing service, you must:

  • Disclose this affiliation to us before creating an account
  • Not access or use the Service without our prior written consent
  • Understand that we reserve the right to deny access or terminate your account

4B.3 Consequences of Violation

Violation of this section constitutes a material breach of these Terms and may result in:

  • Immediate termination of your account and access to the Service
  • Legal action seeking injunctive relief and monetary damages
  • Recovery of our reasonable attorneys' fees and costs
  • Claims for unjust enrichment and disgorgement of profits

4B.4 Permitted Uses

This section does not prohibit: (a) personal, non-commercial use of the Service as intended; (b) legitimate journalism, academic research, or commentary about the Service (with proper attribution); (c) uses explicitly authorized in writing by LookApex. If you are unsure whether your intended use is permitted, contact us at legal@lookapex.com.

5. Court Submissions

When you submit a new court, it enters a pending status until verified by another user. Submitting fake or inappropriate courts may result in account suspension or permanent ban. We reserve the right to remove any court that violates our guidelines without notice.

Anti-Spam Measures: To prevent misuse, court submissions require GPS verification (you must be physically present within 50 meters of the court location) and are limited to one submission per 7-day period per user. These measures help ensure the quality and authenticity of court listings.

Disclaimer: Court information is user-generated. We do not verify the accuracy, safety, legality, or availability of any court. Courts may be on private property, closed, unsafe, or no longer exist. Always verify before visiting.

6. Check-in Accuracy & Location

Check-ins should reflect your actual presence at a court. GPS verification is used to confirm your location. Falsifying check-ins undermines the community and may result in account restrictions or termination.

Location Consent: By checking in, you consent to the collection and display of your general location (court name) to other users. Your exact GPS coordinates are used only for verification and are not shared publicly.

Accuracy Disclaimer: GPS accuracy varies by device and environment. We cannot guarantee perfect location accuracy. False positives and negatives may occur.

7. Account Termination

We reserve the right to suspend or terminate accounts at our sole discretion, with or without cause, and with or without notice. Reasons for termination include but are not limited to:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Behavior that harms other users or the community
  • Extended period of inactivity
  • Request by law enforcement or government agency

You may delete your account at any time through the app settings. Upon deletion or termination, your data will be handled as described in our Privacy Policy.

8. Intellectual Property

LookApex and its content, features, and functionality are owned by us and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8.1 Our Intellectual Property

The following are the exclusive property of LookApex and may not be used without our prior written consent:

  • The LookApex name, logo, and all related branding
  • The Service's user interface, design, and visual elements
  • All software, code, algorithms, and technical implementations
  • The concept, features, and functionality of the basketball court discovery platform
  • All text, graphics, images, and content created by LookApex
  • The database structure and organization of court information

8.2 Prohibited Activities

8.3 Data Scraping & Automated Access

Automated collection of data from the Service is strictly prohibited. This includes but is not limited to:

  • Scraping court locations, coordinates, or metadata
  • Harvesting user profiles, statistics, or activity data
  • Using APIs in unauthorized ways or exceeding rate limits
  • Creating databases or datasets from our data
  • Training machine learning models on our data without explicit written permission

Violation of this section may result in immediate account termination, legal action, and claims for damages including but not limited to statutory damages under applicable computer fraud and copyright laws.

8.4 Your Content

You retain ownership of content you create. However, by posting content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display your content in connection with the Service and our business operations, including marketing and promotional materials.

8.5 Feedback & Suggestions

Any feedback, suggestions, ideas, or improvements you provide become our exclusive property. We may use, implement, modify, and commercialize such feedback without any obligation to you, including without compensation, attribution, or accounting.

8A. Copyright Infringement (DMCA)

We respect the intellectual property rights of others. If you believe that any content on our Service infringes your copyright, you may submit a Digital Millennium Copyright Act (DMCA) takedown notice.

8A.1 Filing a DMCA Notice

To file a valid DMCA notice, send a written communication to our designated Copyright Agent including the following:

  1. A physical or electronic signature of the copyright owner or authorized agent
  2. Identification of the copyrighted work claimed to be infringed
  3. Identification of the material claimed to be infringing, including its location on the Service (URL)
  4. Your contact information (address, phone number, email)
  5. A statement that you have a good faith belief that the use is not authorized by the copyright owner
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner

8A.2 Copyright Agent Contact

8A.3 Counter-Notification

If you believe your content was removed in error, you may submit a counter-notification including:

  • Your physical or electronic signature
  • Identification of the removed material and its prior location
  • A statement under penalty of perjury that you believe the material was removed by mistake
  • Your consent to the jurisdiction of the courts in your district

8A.4 Repeat Infringers

We will terminate the accounts of users who are repeat copyright infringers. A user who receives three (3) valid DMCA notices will have their account permanently terminated without refund.

9. Third-Party Content & Links

The Service may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of third parties. Your interactions with third parties are solely between you and them. We disclaim all liability for any harm resulting from such interactions.

10. Disclaimer of Warranties

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • Court information is accurate, complete, or up-to-date
  • Any court location is safe, legal, or accessible
  • User-provided information is accurate or truthful
  • The Service will meet your specific requirements
  • Any defects will be corrected

11. Limitation of Liability

  • Your access to or use of (or inability to access or use) the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content
  • Physical injury, death, or property damage resulting from your use of the Service
  • Any interactions with other users, whether online or in person
  • Inaccurate court information or location data
  • Data loss or deletion, whether caused by user error, technical failures, security incidents, or any other cause

Data Loss & Backups

While we maintain backups for operational purposes and disaster recovery, we do NOT guarantee the ability to restore individual user data. Backups are created at our discretion and may be incomplete, corrupted, or unavailable.

Your Responsibility: You are solely responsible for maintaining your own backups of any critical data stored in your account. If you delete your account or data, it may not be recoverable, and we are not liable for any resulting loss.

Maximum Liability Cap

To the maximum extent permitted by applicable law, LookApex's total aggregate liability for all claims arising out of or related to your use of the Service shall not exceed the greater of:

  • The amount you paid to LookApex, if any, in the twelve (12) months preceding the claim; OR
  • Fifty US Dollars ($50.00 USD)

Free Service Limitation: Since LookApex is a free service, for most users this liability cap is $50.00 USD.

Jurisdictional Note: Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

11A. Specific Liability Scenarios

To ensure clarity, we explicitly disclaim liability for the following scenarios, which are informed by legal precedents from similar applications:

Physical Activity & Sports Injuries

LookApex is a court discovery platform, NOT a sports organizer. By using our Service, you acknowledge:

  • Basketball and other physical activities carry inherent risks of injury
  • We do not organize, supervise, or control any activities at courts
  • We are not responsible for injuries sustained while playing at any court
  • Court conditions (surface, equipment, lighting) are not verified by us
  • You assume all risks associated with physical activity at any location

Reference: Courts have consistently held that participants assume inherent risks of sports activities (e.g., Joshi v. Fitness International, Regan v. State of New York).

Location Data & Navigation

We do not guarantee the accuracy of court locations or directions. You acknowledge:

  • Court GPS coordinates may be inaccurate or outdated
  • Courts may be closed, removed, or inaccessible
  • We are not responsible for accidents while traveling to courts
  • You are solely responsible for your navigation and travel decisions
  • Distracted driving/walking while using the app is your responsibility

Reference: Courts have ruled that GPS/navigation errors do not create liability for app providers (e.g., Rosenberg v. Google, Waze liability cases). Drivers bear responsibility for safe navigation.

User Interactions & Safety

We do not verify user identities or conduct background checks. You acknowledge:

  • Other users' profiles may be inaccurate or misleading
  • We do not verify user identities, ages, or backgrounds
  • Meeting other users in person is at your own risk
  • We are not responsible for harassment, assault, or misconduct by other users
  • Report concerning behavior but understand enforcement limitations

Reference: Section 230 of the Communications Decency Act shields platforms from liability for user-generated content and user conduct.

User-Submitted Court Information

Courts are submitted by users, not verified by LookApex. You acknowledge:

  • Court information (location, surface, hoops) may be inaccurate
  • Courts may be on private property where access is prohibited
  • We are not liable for trespassing if you enter private property
  • Court conditions may have changed since last reported
  • We cannot verify safety or accessibility of any court

Reference: In Pokémon Go cases, courts found players responsible for trespassing even when directed by the app. Property access decisions are user responsibility.

Gamification & Competitive Features

Any statistics, leaderboards, or achievement features are for entertainment only. You acknowledge:

  • We do not encourage dangerous or reckless behavior to achieve rankings
  • Any injuries sustained while attempting to improve stats are your responsibility
  • Leaderboard competition is not endorsed as a race or timed event
  • You should not take unnecessary risks to improve your in-app metrics

Reference: In Flint v. Strava, the court dismissed claims against Strava after a cyclist died attempting to reclaim a "King of the Mountain" title. Users assume risks of competitive behavior.

Data Security

While we implement security measures, no system is completely secure. You acknowledge:

  • We use industry-standard security but cannot guarantee absolute security
  • In case of a data breach, we will notify affected users as required by law
  • Liability for breaches is limited as stated in Section 11
  • You should use strong, unique passwords and protect your account

Device & Technical Issues

Technical issues with your device or our Service do not create liability. You acknowledge:

  • GPS inaccuracies on your device are not our responsibility
  • Battery drain or device damage from app use is not our liability
  • Service interruptions do not entitle you to compensation
  • Incompatibility with certain devices is not actionable

12. Indemnification

You agree to defend, indemnify, and hold harmless LookApex and its officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your use of the Service
  • Any content you submit or share through the Service
  • Your interaction with other users
  • Any physical activity or injury related to your use of the Service

13. Dispute Resolution

Informal Resolution: Before filing any formal dispute, you agree to first contact us at legal@lookapex.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days.

Class Action Waiver: YOU AND LOOKAPEX AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Time Limitation: Any claim or cause of action arising out of or related to these Terms or the Service must be filed within one (1) year after such claim or cause of action arose, or it shall be forever barred.

14. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Serbia, without regard to its conflict of law provisions. Subject to the exceptions below, any disputes arising from these Terms shall be resolved exclusively in the courts of the Republic of Serbia.

14.1 Compliance with Local Laws

While Serbian law governs these Terms, we comply with applicable data protection and consumer protection laws in the jurisdictions where we operate, including but not limited to GDPR (EU), CCPA (California), COPPA (US), and other applicable regulations. Where local law provides you with greater protections, those protections shall apply.

14.2 European Union Users

For EU users, the following additional rights and protections apply:

  • Consumer Protection: Your statutory consumer rights under EU consumer protection directives (including the Consumer Rights Directive 2011/83/EU) remain fully applicable
  • Forum Selection: You may bring legal proceedings in the courts of your country of residence for matters relating to consumer contracts
  • Alternative Dispute Resolution: You may use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr
  • GDPR Rights: Your data protection rights under GDPR (Articles 15-22) are fully preserved, including the right to lodge a complaint with your local supervisory authority
  • Unfair Terms: Any terms found to be unfair under the Unfair Contract Terms Directive (93/13/EEC) shall not be binding on you

14.3 United States Users

For users in the United States, the following applies:

  • Federal and state consumer protection laws remain applicable where they provide greater protection
  • California users retain all rights under CCPA (California Consumer Privacy Act)
  • Residents of states with specific privacy laws retain those rights (Virginia, Colorado, Connecticut, etc.)

14.4 Other Jurisdictions

If you access the Service from other jurisdictions, you are responsible for compliance with local laws. We make no representation that the Service is appropriate or available for use in all locations. Those who access or use the Service from other jurisdictions do so at their own volition and are responsible for compliance with local law.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and LookApex concerning the Service and supersede all prior agreements, understandings, negotiations, and discussions.

17. Changes to Terms & Re-Consent

We reserve the right to modify these Terms at any time. Depending on the nature of the changes, different notification and consent procedures apply.

Types of Changes

Non-Material Changes

Minor updates that do not affect your rights or obligations (e.g., clarifications, typo fixes, formatting changes, adding examples).

Notification: We will display an informational banner in the app. You can dismiss it and continue using the Service.

Your action: No explicit acceptance required. Continued use of the Service constitutes your acknowledgment of the changes.

Material Changes

Significant updates that affect your rights, obligations, or liability (e.g., new prohibited conduct, changes to warranties, modifications to dispute resolution, new fee structures, changes to service scope).

Notification: We will send you an email notification and display a blocking modal in the app. You must review and accept the changes to continue using the Service.

Your action:

  • Users aged 16+: You must click "I Accept" in the app to continue using the Service.
  • Users under 16 (with parental consent): Your parent/guardian will receive a new consent email. They must provide a fresh parental consent code for you to continue using the Service.

If you do not accept: You will not be able to continue using the Service. You may request account deletion and data export via legal@lookapex.com.

How You Will Be Notified

  • Posting the updated Terms on this page
  • Updating the "Last updated" date and version number at the top
  • Sending an email notification (for material changes)
  • Displaying a prominent notice or modal in the app

18. Service Availability & Development Status

18.1 No Guarantee of Availability

We do not guarantee that the Service will be available at all times. The Service may be subject to:

  • Scheduled maintenance and updates
  • Unplanned downtime due to technical issues
  • Service interruptions beyond our control (network issues, third-party service outages)
  • Feature changes, additions, or removals
  • Geographic restrictions or limitations

18.2 Feature Changes

We reserve the right to modify, suspend, or discontinue any feature or functionality of the Service at any time, with or without notice. This includes but is not limited to:

  • Adding, modifying, or removing features
  • Changing the user interface or user experience
  • Modifying gamification elements (badges, statistics, leaderboards)
  • Changing the check-in system or verification methods
  • Altering court discovery or search functionality

18.3 No Compensation for Changes

You acknowledge that you have no expectation of permanence regarding any feature or functionality. We shall not be liable for any changes, modifications, or discontinuation of features. No compensation, refund, or credit will be provided for any changes to the Service, even if such changes affect your ability to use the Service or diminish its value to you.

19. Service Discontinuation

We reserve the right to discontinue, suspend, or terminate the Service at any time, with or without cause, and with or without notice. In the event of planned service discontinuation:

  • Notice Period: We will provide at least 30 days advance notice via email and in-app notification before discontinuing the Service
  • Data Export: Users will have the opportunity to export their personal data during the notice period via the app's Privacy & Data settings
  • Data Deletion: Upon service termination, all user data will be permanently deleted within 30 days, except where retention is required by law
  • Legal Requirements: Records required by law (consent records, parental consent for minors) will be securely archived for the legally mandated period, then destroyed

19.1 Legal Records Retention After Service Termination

Even after service discontinuation, we are legally required to retain certain records to comply with data protection and consumer protection laws:

  • Parental Consent Records: Retained until the minor reaches 18 years of age plus 5 years (statute of limitations), as required by applicable law. These records are stored in secure, encrypted archives accessible only for legal compliance purposes.
  • Terms Acceptance Records: Retained for 7 years after account creation as required by contract law and tax regulations.
  • Dispute Records: If there is an ongoing legal dispute at the time of service termination, relevant records will be retained until the dispute is resolved plus applicable statute of limitations.

You acknowledge that we shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

20. System Requirements & Compatibility

The Service is provided as a web application accessible through modern web browsers. We make reasonable efforts to ensure compatibility with commonly used devices and browsers, but cannot guarantee compatibility with all devices, operating systems, or browser versions.

Minimum Requirements: The Service requires a device with internet connectivity, location services capability, and a modern web browser (Chrome, Safari, Firefox, Edge - latest 2 major versions). Some features may require JavaScript to be enabled.

No Guarantee of Compatibility: We do not guarantee that the Service will function properly on all devices, operating systems, or browser configurations. Certain older devices, outdated operating systems, or modified/rooted devices may not be supported. We reserve the right to discontinue support for specific platforms or versions at any time without notice.

Location Services: Check-in functionality requires accurate GPS/location services. Devices with disabled, malfunctioning, or inaccurate location services may not be able to use all features. We are not responsible for issues arising from device hardware limitations or location service inaccuracies.

Updates: We may update the Service at any time, which may change system requirements. It is your responsibility to ensure your device meets current requirements. We are not liable for any inability to access or use the Service due to device incompatibility.
